Compensation Fraud in NYIn 1996 a war began in the State of New York, a war on the injured worker and an effort to portray the system as filled with thieves and cheats unworthy of the meager benefits to which they might be entitled under the law. The purpose of the campaign was clear: discourage the filing of claims by innocent injured victims of workplace injury, intimidate the injured into forgoing rights and benefits and thereby save businesses and insurance companies money. Those of you that read Consumer Reports have read the article on Workers' Compensation and are familiar with the conclusion reached by its editors: the allegations of rampant fraud were false and designed to inflame the public and legislators, thereby permitting passage of so-called reforms that would further limit the already meager rights of the injured worker. Now the drum is beating again, the allegations of corruption in the system are once again being heard, at least here in New York where new "reform" legislation has been proposed by the Governor on behalf of the Business Council which would severely restrict the protection provided by the statute to the Worker.
